Established standards and commitment to learning
A lawyer may submit an application to become a Certified Specialist when they meet the following established standards by the Law Society of Ontario:
- They have practiced law for a minimum of seven (7) years prior to the date of their application; and
- They demonstrate having substantial involvement in the specialty area during 5 of the 7 years. Substantial involvement can be established through mastery of practices and procedures; concentration of practice in the specialty area; and compliance with the professional standards requirements.
Once recognized, a Certified Specialist must continue to pledge dedication to their professional development by completing the annual requirements. Annually, a Certified Specialist must:
- Complete and file a Certification of Annual Report, attesting to compliance with the Administrative Policies Governing the Certified Specialist Program, and
- Complete 10 hours of Continuing Professional Development (CPD) in their specialty area every year, in addition to the 12 hours of CPD required by all licensed lawyers providing legal services annually.
Further demonstrating their commitment to staying current in the field.
In addition to the qualifications and maintenance requirements, Certified Specialists are required to uphold a self-accountable ethical standard. Should a Certified Specialist fail to meet the minimum standards of their area of specialty at any time during their certification, they must notify the Certified Specialist Program in writing by email or by regular mail immediately. This self-regulated approach demonstrates the integrity and honesty of the Program, and the Certified Specialists recognized within it. The Certified Specialist Program retains the authority to revoke the specialist status if warranted.
